These Terms of Service ("Terms") govern your use of the Emotiva mobile application and website (collectively, the "Service"). By creating an account or using the Service, you agree to be bound by these Terms.

You must be at least 13 years of age to use Emotiva. If you are under 18, you confirm that you have your parent or guardian's permission to use the Service.

By using the Service, you represent that you meet these eligibility requirements.

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify us immediately of any unauthorised access to your account.

You agree to provide accurate and current information when registering and to keep your account information updated.

You agree not to use Emotiva to:

• Violate any applicable laws or regulations
• Attempt to gain unauthorised access to the Service or other users' data
• Interfere with or disrupt the integrity or performance of the Service
• Use the Service for any commercial purpose without our permission
• Upload or transmit harmful, offensive, or illegal content

Emotiva is a self-tracking and wellness tool, not a medical device, clinical service, or substitute for professional mental health care.

Nothing in the app should be interpreted as medical advice, diagnosis, or treatment. If you are experiencing a mental health crisis, please seek help from a qualified professional or contact an emergency service in your country.

All content, design, code, and trademarks within Emotiva are owned by or licensed to Emotiva. You may not copy, reproduce, distribute, or create derivative works without our express written permission.

Your mood entries, notes, and other data you create remain yours. By using the Service, you grant us a limited license to store and process your data solely for the purpose of providing the Service.

You may delete your account at any time from the app settings. Deletion will permanently remove all your data from our servers.

We reserve the right to suspend or terminate accounts that violate these Terms, with or without notice.

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components.

To the fullest extent permitted by law, Emotiva shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Service.

We may update these Terms from time to time. When we make significant changes, we will notify you via the app or email. Your continued use of the Service after changes are posted constitutes acceptance of the new Terms.
